Your Rights as a Maryland Tenant with a Pet

Maryland caps total deposits at 2x monthly rent, limiting pet deposit amounts. The Baltimore-DC corridor has high concentrations of corporate landlords using pet fee platforms. MCCR actively enforces fair housing protections.

What Maryland Law Actually Says

Maryland's landlord-tenant law under Real Property Article §8-203 caps security deposits — including pet deposits — at 2x monthly rent. Landlords must hold deposits in a federally insured financial institution and pay interest annually (currently 4%).

Deposits must be returned within 45 days after tenancy ends with a written statement of any deductions. Landlords who wrongfully withhold deposits can be liable for 3x the withheld amount plus attorney fees in Maryland.

Maryland's DC suburbs (Montgomery County, Prince George's County) have high volumes of ESA-related complaints given the large federal employee workforce and high rental prices. MCCR has increased enforcement actions in recent years.

Emotional Support Animals: Maryland Landlords CANNOT Charge Fees

Under the federal Fair Housing Act (FHA) and HUD guidelines, emotional support animals (ESAs) and service animals are not classified as "pets." This means:

  • Landlords cannot charge pet deposits for an ESA or service animal
  • Landlords cannot charge monthly pet rent for an ESA
  • Landlords cannot require PetScreening or similar paid screenings for ESAs
  • Landlords can request documentation from a licensed mental health professional — but this documentation must be reasonable and is limited in scope
  • Landlords cannot demand your specific diagnosis, medical records, or charge an application fee for ESA accommodation requests

What Maryland Landlords CANNOT Do

  • Collect deposits exceeding 2x monthly rent
  • Charge pet fees, deposits, or pet rent for documented ESAs
  • Require ESA owners to use paid screening services
  • Fail to return deposits within 45 days
  • Discriminate based on disability under Maryland Fair Housing Act
